Respondent/Complainant Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the grounds filed therein, the High Court may be pleased to enlarge the petitioner on anticipatory bail in the event of her arrest by the Police in FIR No. 66/2018 of Chikkadapally Police Station of Hyderabad City. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri T.Sreedhar, Advocate for the Petitioner and of the Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:
" This petition is filed, under Section 438 of the Code of Criminal Procedure, 1973 (for short. 'Cr.P.C.'), seeking for grant of anticipatory bail to the petitioner-accused in Crime No. 66 of 2018 of Chikkadapally Police Station, Hyderabad city, registered for the offences punishable under Selctions 420 and 406 IPC.
2. Heard learned counsel for the petitioner and learned Public Prosecutor (T.S.).
3. The allegations against the petitioner are that she withdrew some amount from the account of the de facto complainant, who is no other than her father. Learned counsel for the petitioner submits that earlier, the de facto complainant himself gave a letter to Kotak Bank, by which he wanted the total amount to be transferred to the petitioner.
4. Hence, considering the above and also considering the submission of learned counsel for the petitioner that the petitioner is suffering from ailment and also considering the material filed by the petitioner which shows that she is suffering from abnormal hyper intense signals, this Court is inclined to grant anticipatory bail to the petitioner. The petitioner is directed to surrender before the Station House Officer, Chikkadapally Police Station, Hyderabad City, within 15 days from the date of this order. On such surrender, the petitioner shall be released on bail on her executing a personal bond for a sum of Rs. 10,000/- (Rupees ten thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer. Further, on such release, the petitioner shall abide by the conditions mentioned under Section 438(2) Cr.P.C. as under:
(i) The petitioner shall make herself available for interrogation by a police officer as and when required.
(ii) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any persona acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; (iii) The petitioner shall not leave India without the previous permission of the Court.
