THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17715 of 2011 ORDER:

The present writ petition is filed questioning the inaction of the respondents 2 and 5 in considering the representation dated 16-122010 made by the petitioner to provide house site pattas to landless poor.

The averments in the writ petition show that in the year 1998-99 an extent of Ac.04-77 cents of land in Survey No.285/7, 285/B4 and 248/1 of Korlakota village, Amadalavalasa Mandal, Srikakulam District was acquired for the purpose of providing house sites under Rural Permanent Housing Scheme (RPH scheme). After acquisition, the same was converted into 191 house sites. It is stated that the Government has identified 156 beneficiaries and accordingly, house sites were sanctioned to them. About 31 vacant open plots, which were still available to be allotted under RPH scheme. It is stated that among 156 beneficiaries to whom the house sites were allotted, only 63 beneficiaries have constructed the houses.

It is further stated that there are several irregularities in identifying the beneficiaries and house sites were allotted to benami people. The petitioner and others who were expecting house sites have objected the selection list and gave a representation dated 01-02-2010 to the Housing Minister which in turn, was forwarded to the 1st respondent. But no action has been initiated till date. It is alleged that though the Government has acquired land in the year 2003-2004, till date no action has been taken to provide house sites to the landless persons. Taking advantage of the situation, several persons have encroached on the land. Having regard to the said situation, the petitioner and other landless poor persons made a representation dated 16-12-2010 to the Collector, who is the Executive Director, A.P.S.H.C.L.

requesting him to allot the house sites to the petitioner and other villagers.

Without going into the merits of the matter and taking into consideration the circumstances referred to above, the writ petition is disposed of directing the respondents 2 and 5 i.e. the District Collectorcum-Executive Director, APSHCL, Srikakulam and the Tahsildar, Amadalavalasa Revenue Mandal, Amadalavalasa, Srikakulam District to consider the representation dated 16-12-2010 made by the petitioner and pass orders in accordance with law within a period of three months from the date of receipt of the order, if the said representation is still pending consideration. As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
