THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.33123 OF 2015 ORDER:

In this writ petition, the petitioners seek a direction to the respondents 3 to 5 not to interfere with the petitioners' rights over the subject lands without following due process of law. Heard Sri V.R.Reddy Kovvuri, learned counsel for the petitioners, Sri Somaraju, learned Assistant Government Pleader for Land Acquisition (Andhra Pradesh) and Sri Sheshank Reddy, learned Assistant Government Pleader for Roads & Buildings (Andhra Pradesh).

Considering the limited grievance of the petitioners, without going into the merits of the case, the respondents are directed not to dispossess the petitioners from the subject-lands without following due process of law in the event of acquisition of the said land. However, the petitioners are directed to cooperate with the respondents if any proceedings are initiated for the purpose of conducting survey to note down the exact extent of the subjectland which they intend to require for the purpose of public utility and to initiate the acquisition proceedings. It is also made clear that in the process of any survey, the respondents shall not cause any damage to the standing crop or property over the subjectland. With the above directions, the writ petition is disposed of. No costs.
