HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.28020 OF 2009 ORDER:

This writ petition is filed challenging the order dated 22.1.2009, passed by the Additional Industrial Tribunal-cumAdditional Labour Court, Hyderabad in I.A.No.125 of 2008 in M.P.No.51 of 2003, setting aside the exparte orders and permitted the Management to participate in the impugned M.P proceedings. Challenging the same, the present writ petition is filed. Having regard to the facts and circumstances of the case, this Court is of the considered view that the present writ petition is not maintainable as interlocutory orders passed in M.P No.51 of 2003, are before the Additional Industrial Tribunal-cum-Additional Labour Court, Hyderabad, no prejudice has been caused to the petitioner and the main M.P.No.

51 of 2003, is still pending before the Additional Industrial Tribunal-cum-Additional Labour Court, Hyderabad, the ends of justice would be met, if a direction is given to the Labour Court to decide the M.P.No.51 of 2003, filed by the petitioner, as expeditiously as possible, preferably within a period of three months from the date of receipt of copy of this order. With these observations, the writ petition is dismissed. No order as to costs.
