HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.24946 OF 2017 ORDER:

This writ petition is filed seeking a direction to declare the action of the respondents in widening the Siddipet-Kamareddy R&B Road causing demolition of the properties of the petitioner without following due process of law as illegal and arbitrary.

Now a counter affidavit is filed by the fourth respondent stating that the Government accorded administrative sanction on 16.06.2017 for widening the road Machareddy-Mustabad-Siddipet and accordingly the fifth respondent surveyed and marked the land. Certain encroachments were noticed and notices were issued on 21.07.2017 to the petitioners to submit their documents in order to know whether the petitioners have got any title or not. It is also stated that the R&B Department will commence the road widening work only after handing over the vacant clear site. In the meantime, the R&B Department is executing the work on available existing R&B boundary only. No demolition work was initiated by the R&B Department.

In view of the above statements made in the counter affidavit, it is open to the petitioners to submit their title deeds to the fifth respondent and the fifth respondent shall consider the same and shall not interfere without following due procedure for acquiring the land if the title of the petitioners relates to the land claimed by the petitioners. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any pending, in this writ petition, shall stand closed.
