THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.33296 of 2017 ORDER:

The petitioner prays for the following relief :- " ..... to issue a Writ of Mandamus or any other appropriate writ, order or Direction more particularly one in the nature of Writ of Mandamus, to declare the inaction of the 2nd respondent to 4th respondents herein, neither registering crime nor arresting the accused, pursuant to petitioner cognizable complaint made on 19.09.2017, with endorsement, as per the Apex Court Judgment held in Lalithakumari Case, as illegal, arbitrary, unjust and consequently direct the respondent authorities herein, forthwith register the criminal case and arrest the accused, i.e., 5th unofficial respondent to 8th unofficial respondents herein, pursuant to the petitioner criminal complaint on 19.09.2017....." .

Learned Assistant Government Pleader, on instructions, submits that having regard to the nature of allegations in the complaint, the complaint is received by the 4th respondent and an entry in the General Diary is also made. The matter is investigated by the 4th respondent and if a case is made out either in the c omplaint or in the investigation, needful will be done, otherwise, the steps in this behalf would be informed to petitioner.

The statement is placed on record.

The petitioner is given liberty to work out remedies against any communication given by respondents in this behalf. The writ petition is disposed of accordingly. No order as to costs.
