THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13766 of 2015 ORDER:

This Criminal Petition is filed by the petitioner-accused No.2 under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.04 of 2011 on the file of Humayun Nagar Police Station, Hyderabad, registered for the offence punishable sunder Section 382 IPC. Heard and perused the material available on record. The allegation against the petitioner is he, along with other two persons, snatched away the gold chain of the de facto complainant. Learned counsel for the petitioner submitted that the petitioner was arrested in similar cases and subsequently, he was released on bail, and he was falsely implicated in the present case, which is similar to the earlier crimes.

Learned Public Prosecutor objected for grant of bail to the petitioner on the ground that the charge sheet in the present case is not yet filed and custodial interrogation of the petitioner is necessary. Considering the submission of the learned Public Prosecutor, this Court is not inclined grant anticipatory bail to the petitioner.
