HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.29144 of 2016 ORDER:

Vide the present petition, the petitioner seeks Mandamus declaring the action of 2nd respondent in not considering the reference application of the petitioner dated 21.11.2015 filed under Section 64 of the Act 30 of 2013, as illegal and arbitrary. Learned counsel appearing on behalf of the petitioner submits that the petitioner made reference application on 21.11.2015 filed under Section 64 of the Act 30 of 2013. However till date no decision has been taken on his application by 2nd respondent.

Learned Government Pleader for Land Acquisition has assured this Court that the reference application of the petitioner shall be posted before the authority to be constituted under Section 51 of the Act 30 of 2013.

Keeping in view the averments made in the instant petition and statement made by the learned Government Pleader, I hereby direct 2nd respondent to place the reference application of the petitioner before the authority within two (02) weeks to be constituted under Section 51 of the Act 30 of 2013 from the date of its Constitution.

With the above direction, this Writ Petition is disposed of. No costs. Pending miscellaneous petitions, if any, shall stand closed.
