HON'BLE SRI JUSTICE SANJAY KUMAR AND HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.18313 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The prayer of the petitioner in this case is as under: "It is therefore prayed that this Hon'ble Court may be pleased to issue order or direction one in the nature of writ of Mandamus directing the first respondent to permit the petitioner to withdraw LGC No.30 of 2012 pending before it and consequentially direct the first respondent to return the original documents filed in the above matter and pass such other order or orders as this Hon'ble Court may deem fit and proper by in the circumstances of the case.

The Government of Telangana issued G.O.Ms.No.113, Revenue (Land Matters) Department, dated 01.06.2016, in exercise of powers under Section 101 of the A.P.Reorganization Act, 2014, repealing the A.P.Land Grabbing (Prohibition) Act, 1982, insofar as it applies to the State of Telangana.

As regards cases in which cognizance has already been taken by the Special Court/Special Tribunal, the G.O. provides for transfer thereof to the respective civil Courts as specified therein. This being the situation, as the petitioner states that he is aware of the transfer of L.G.C.No.30 of 2012, wherein an application has already been filed seeking withdrawal and for return of original documents, it would be open to the petitioner to pursue the matter before the Court concerned only after transfer of the case. The Writ Petition is accordingly closed. Consequently, pending miscellaneous petitions, if any, shall also stand closed.
