IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA AND THE STATE OF ANDHRA PRADESH WEDNESDAY THIS THE 15th DAY OF APRIL, TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE R.KANTHA RAO Between:

L.Satyanarayana ..... PETITIONER And The State of A.P. rep. by its Principal Secretary,Food,Civil Supplies,Hyderabad and two others .....RESPONDENTS The Court made the following:

THE HON'BLE SRI JUSTICE R.KANTHA RAO ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies of the State of Andhra Pradesh. It is contended by the learned counsel appearing for the petitioner that earlier the same Revenue Divisional Officer resorted to suspend the authorization of the petitioner, and against that order, a writ petition was filed and in that writ petition, the R.D.O. appeared before this Court and submitted to the Court that he issued proceedings revoking the suspension order, on that the said writ petition was closed admonishing the R.D.O.

The learned counsel appearing for the petitioner further submits that without conducting enquiry into the said allegations, again the same R.D.O. passed the suspension order impugned in the present writ petition on flimsy grounds. The learned Government Pleader for Civil Supplies submits that the present suspension order is passed in respect of different irregularities and therefore, the order passed by this Court in the earlier writ petition has nothing to do with the present writ petition.

Considering all aspects of the matter, the writ petition is disposed of directing the second respondent/R.D.O. to complete the enquiry and pass final orders within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed in consequence.
