Venkat Rao Memorial Trust Laldarwaza, v. The State Of Telangana Represented By Its Principal
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11525 OF 2017 ORDER:
The grievance of the petitioner is that he filed an appeal in Case No.B/ROR/802 of 2007 under Section 5 of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 (for short 'the Act') before the Revenue Divisional Officer-3rd respondent against the order dated 09.08.2004 in respect of the land in Sy.Nos. 1274, 1275, 1276, 1270, 1271, 1272, 1281 and 1282 of Nandigam Village, Kothur Mandal, Mahbubnagar District. The appellate authority granted status-quo order on 05.03.2017. Thereafter, the petitioner made petitions and also memos on 14.01.2016, 21.03.2016 and 23.02.2017 requesting the 3rd respondent to dispose of the appeal. In spite of the same, the 3rd respondent neither taken up the matter for hearing nor issued notices to the parties concerned. Aggrieved by the same, the present writ petition is filed.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. Since it is stated that due to Bifurcation of Districts, the appeal is pending before the 5th respondent, the 5th respondent is directed to dispose of the appeal filed by the petitioner in accordance with law, after issuing notice to the affected parties if any.
(03) months from the date of receipt of copy of this order.
With the above direction, the writ petition is disposed of No costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 03.04.2017 dv
