This Criminal Petition is filed seeking quashment of PCOR No.722 of 2015-16 on the file of Station House Officer, Prohibition and Excise Station, Shadnagar registered against the petitioners/Accused No.3 and 4 for the offences under Section 7(A) read with Section 8(e) and Section 13(1) of the Andhra Pradesh Prohibition Act, 1995; Section 34(e) of the Andhra Pradesh Excise Act, 1968 and Section 3(b) and 4(1)(ii) of GUR (Regulation of Use) Order, 1968.

Sri T.V.Ramana Rao, learned Additional Public Prosecutor for respondent/State are present.

No representation on behalf of the petitioners.

Learned Additional Public Prosecutor for respondent No.1/State has submitted a copy of final report, which was filed before the I Additional Judicial Magistrate of First Class, Shadnagar, to close the case against the accused as per the Orders from the Office of Director of Enforcement (Prohibition and Excise department), Hyderabad vide Crime

No.2426/2014/DOE/H-2, dated 13.04.2016, wherein the Court vide Order dated 15.12.2022, has accepted the final report and accordingly the case is closed.

Same is taken on record.

Considering the facts and circumstances discussed above, this Court is of the opinion that since the very purpose of filing this Criminal Petition has already been defeated, this Criminal Petition has become infructuous and liable to be dismissed.

Accordingly, this Criminal Petition is dismissed as infructuous.

As a sequel, pending Miscellaneous Applications, if any, shall stand closed.
