HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.37151 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is preferred by the petitioners seeking the following relief: " .... to issue writ or order or direction more particularly one in the nature of Writ of Mandamus declaring action of the Respondent No.2 in passing orders through proceeding No.12/78/2016 dated 25.5.2016 without following the Government Orders through G.O.Ms.No.59 Rev (Assn.I) Dept. 30.12.2014 and G.O.Ms.No.12 Rev. (Assn.II) Dept. dated 30.1.2015 and without dispose of the representations filed by the Petitioner on 6.7.2016 and 17.9.2016 on the subject of difference of amount Rs.15,91,000-00 between the calculation and the payment to be made in regard to the regularization of land 224.5 Sq. Yards pertaining to House No. 8-3-231/255/C situated in Sri Krishna Nagar, Shaikpet Mandal in Ts.

No 2/1 Block-A, Ward No.10 correlated to Survey No.403/p Shaikpet, Hyderabad in favour of petitioner as illegal, arbitrary and unjust consequently direct the Respondent No.2 to pass revised orders in accordance with rules prevailing by issuing revised endorsement for the regularization of the said property in favour of the Petitioner and pass such other order or orders as this Hon'ble Court may deem fit and proper ill the interest of justice."

Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents. With their consent, the writ petition is disposed of at the stage of admission itself.

perusal of the material on record would show that vide proceedings No.E/07/69/2015 dated 31.08.2015, the Tahasildar - 5th respondent held as under:

" In view of the above the applicant Sri M A Saleem S/o.Late Mohd. Abdul Mannan is hereby directed to pay the balance amount shown at Sl.No.

(6_ (Rs.29,74,125/-) by way of Demand Draft in favour of Tahasildar, Shaikpet Mandal for further action. Failing to pay the balance amount within stipulated time i.e. on or before 31.12.2015 the applicant will disentitle to seek regularization."

Though the petitioner has made two applications dated 06.10.2016 and 17.09.2016 before the 2nd respondent-Joint Collector, no orders are passed thereon, hence the present writ petition is filed.

Learned AGP would submit that the 2nd respondent may be directed to dispose of the representations of the petitioner, if not already disposed of at the earliest.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent-Joint Collector to pass appropriate orders on the representation of the petitioner dated 17.09.2016, if the same is still pending, in accordance with law as early as possible, preferably within a period of three months from the date of receipt of a copy of this order.
