THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 15497 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner was appointed as Fair Price Shop Dealer of Shop No.15 of P. Kondapuram, h/o Pamidi Village and Mandal, Anantapuram District, on permanent basis in the year 2011. While so, the 2nd respondent issued a show cause notice on 24.03.2015 asking the petitioner to submit his explanation to the charges framed against him. The petitioner submitted his explanation on 18.04.2015. After considering the explanation, the 2nd respondent passed the impugned order on 20.04.2014 (sic.20.04.2015). Challenging which, the present writ petition is filed.

3. In the ultimate para of the order, the 2nd respondent stated that in view of the gravity of the irregularities committed by the dealer, he thought it fit to suspend the dealership. The learned counsel for the petitioner submits that since the order does not indicate the period of suspension, it should be construed as a final order, as the 2nd respondent already gave findings considering the explanation submitted by the petitioner. But the learned Government Pleader submits that this is only an interim order subject to further orders to be passed after conducting appropriate enquiry. Since the petitioner has already submitted his explanation to the charges leveled against him, what remains is only a further enquiry by the 2nd respondent. In the circumstances, the writ petition is disposed of directing the 2nd respondent to complete the enquiry on the charges leveled against the petitioner within a period of 30 days from the date of receipt of a copy of this order duly following the principles of natural justice and giving a due opportunity to the petitioner.

4. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
