THE HONOURABLE DR.JUSTICE G. RADHA RANI CRIMINAL PETITION No.3847 of 2024 O R D E R:

This Criminal Petition is filed by the petitioner - A1 under Sections 437 and 439 of Code of Criminal Procedure for grant of regular bail in Crime No.47 of 2024 on the file of PS Maripeda, Mahabubabad District, registered for the offences punishable under Sections 8(c) read with 20(b)(ii)(B) of Narcotic Drugs and Psychotropic Substances Act, 1985.

The case of the prosecution in brief was that on 13.03.2024 at 21:00 hours, while the Sub-Inspector of Police of PS Maripeda was conducting vehicle checking along with his staff at the out-skirts of Maripeda, at about 21:45 hours, they found two persons proceeding on a Hero Honda Splendor Bike carrying a white bag in between them. He stopped the vehicle and on checking found five packets in the white bag containing dry ganja. He seized 10.1 Kgs of dry ganja found in the said bags under the cover of panchanama, apprehended A1 and A2 and lodged the report.

Basing on the said report, the above crime was registered. 4.

Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor for the respondent - State.

Learned counsel for the petitioner submitted that only an intermediary quantity of dry ganja was seized. There were no criminal antecedents reported against the petitioner and prayed to enlarge the petitioner - A1 on bail. 6.

Learned Assistant Public Prosecutor opposed grant of bail to the petitioner - A1, but reported that there were no criminal antecedents against the petitioner - A1.

Considering the submissions of the learned counsel for the petitioner and the learned Assistant Public Prosecutor and as only an intermediary quantity of dry ganja was seized from the possession of the petitioner and no criminal antecedents were reported against him, it is considered fit to enlarge the petitioner on bail.

In the result, the Criminal Petition is allowed and the petitioner - A1 is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand) with two sureties for a like sum each to the satisfaction of the Special Judge for Trial of Cases for the offences under Narcotic Drugs and Psychotropic Substances Act, 1985 - cum - Principal Sessions Judge at Mahabubabad. The petitioner - A1 shall comply with the conditions laid down under Section 437(3) of Cr.P.C.
