Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 4.
This Writ Petition is filed seeking to declare the action of the 3rd respondent in suspending the authorization of the petitioner for an indefinite period, as arbitrary and illegal. The petitioner is the dealer of fair price shop No.12, Chinna Devalapuram Village, Bandi Atmakur Mandal, Kurnool District. On 27.01.2015 the Special Deputy Tahsildar (CS), Nandyal, inspected the said fair price shop, noticed certain variations in the stock, & irregularities and recommended to take action against the petitioner. Based on the said ground, the 3rd respondent suspended the authorization of the petitioner vide proceedings dated 29.1.2015. Aggrieved thereby, the petitioner preferred appeal along with stay application before the 2nd respondent-Joint Collector. But, so far no orders have been passed either in the stay application or appeal.
Learned counsel appearing for the petitioner submits that if the respondents propose to initiate enquiry, the same may be directed to be completed within a reasonable period. In view of the aforesaid submissions, the Writ Petition is disposed of directing the 3rd respondent-Revenue Divisional Officer, Nandyal, Kurnool District, to conduct enquiry and pass final order within a period of eight weeks from the date of receipt of
a copy of this order, not withstanding the pendency of the appeal. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
