HON'BLE SRI JUSTICE R.KANTHA RAO Writ Petition No.13671 of 2015 Date: 16-6-2015 Between Dr. Abdul Quayum ... Petitioner and Maulana Azad National Urdu University, Rep. by its Registrar, Gachibowli, Hyderabad, Telangana;

and another ... Respondents HON'BLE SRI JUSTICE R.KANTHA RAO Writ Petition No.13671 of 2015 Order:

Heard Sri Mir Masood Khan, learned counsel appearing for the petitioner and Sri K.Ramakanth Reddy, learned Standing Counsel for

the respondents-Maulana Azad National Urdu University (the University, for short).

2. A departmental enquiry is initiated against the petitioner by the respondents-University on certain charges by appointing a retired District Judge as Enquiry Officer. The grievance of the petitioner is that several documents basing on which the charges have been framed were not furnished to him and therefore, he is not in a position to make up his defence in the proposed enquiry. He submitted a written representation dated 25-4-2015 to the 2nd respondent-Registrar to furnish all the documents which are relevant for the purpose of the enquiry proposed against him. According to the petitioner, inspite of the written representation, no documents have been furnished to him and therefore, he filed the present writ petition with a prayer to issue a direction to the 2nd respondent to take action on his representation dated 25-4-2015 and furnish the documents to him.

3. At the time of hearing of the writ petition, the learned Standing Counsel for the respondents-University furnished certain documents to the learned counsel appearing for the petitioner in the open Court. The learned Standing Counsel also made a statement to the effect that if any other documents are required by the petitioner, he can obtain those documents from the Enquiry Officer.

4. Since the short question of furnishing of documents to the petitioner in the departmental enquiry is involved in the present writ petition, the writ petition is disposed of with a direction to the Enquiry Officer to furnish the documents, if any, required by the petitioner in connection with the enquiry before taking any further steps in the course of enquiry. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
