THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.21125 of 2016 ORDER:
Heard Mr.S.Rajkumar for petitioner and the learned Government Pleader for Forest.
The petitioner prays for the following relief :- " ......to issue appropriate Writ, direction, or order more particularly one in the nature of Writ of Mandamus or any other Writ or order/ direction to Respondents to save Forests Land in Timmapur Village sivar, Damarcharla Mandal from encroachment...."
The 4th respondent filed counter affidavit and the relevant portion reads as follows :- " .....it is submitted that the Telangana State Government proposed to construct a thermal power plant namely Yadadri Thermal Power Station with a capacity of 4800 MW in Veerlapalem Village of Damercherla Mandal of Nalgonda District. For this purpose the Telangana State Government is required 4676 acres of Forest land of Reserve Forest Veerlapalem Block in addition to the Revenue lands. The Government of India has given permission for diversion of 4676 acres of Forest land in RF Veerlapalem Block duly following the norms of the Forest Conservation Act, 1980. In the forest lands near Thimmapur Shivar an area of 100 acres was dis-reserved by the State Government vide G.O.Ms.No.2204 dt.27.11.1970 and allotted to the landless poor people. The 100 acres land was handed over to the Revenue Department in 1971. The respondent No.5 is not encroached forest land in Thimmapur village Shivar is in position of land which falls in the Dis-reserved area."
Counsel for petitioner, having regard to the stand taken in the counter affidavit, submits that the grievance, as originally canvassed, does not survive for consideration and hence, does not press the writ prayer.
The statement is placed on record.
The writ petition is dismissed accordingly. No order as to costs.
