THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.33613 of 2015 ORDER:
The petitioner was appointed as a permanent fair price shop dealer of shop No.14, Mallemdoddi Village, Maldakal Mandal in Mahabubnagar District. The authorisation of the petitioner is valid up to 31.03.2017. The shop was inspected on 13.07.2015 and some irregularities were noticed. Based on the same, a show cause notice was issued on 24.08.2015 and the petitioner submitted his explanation on 10.09.2015. After considering the same, the authorisation of the petitioner was suspended on 26.09.2015. Challenging the same, the present Writ Petition is filed. A perusal of the charges leveled against the petitioner discloses that they need enquiry.
In the circumstances, this Court is not inclined to interfere with the enquiry process at this stage. However, the third respondent is directed to conduct an enquiry in respect of the allegations by giving due opportunity to the petitioner, and pass final orders thereon, within a period of sixty days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________
