This Criminal Petition, under Sections 438 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ A.1 & A.2, for grant of pre-arrest bail apprehending their arrest in connection with Crime No.7 of 2018 of Kadiri Town Police Station, Anantapur District, registered for the offences punishable under Sections 341, 353 read with 34 of I.P.C. and Section 3(1)(s) of The Scheduled Castes and The Scheduled Tribes (Prevention of Atrocities) Act, 1989.

Having argued the matter for some time, the learned counsel for the petitioners/ A.1 & A.2 requested this Court to issue a direction to the Station House Officer concerned to follow the procedure laid down under Section 41-A of Cr.P.C. before arrest of the petitioners/ A.1 & A.2, since the petitioner/ A.1 is a Government employee.

Since the offences allegedly committed by the petitioners/ A.1 & A.2 are punishable with imprisonment for less than seven years, the request of the learned counsel for the petitioner/ A.1 & A.2 can be acceded to. Accordingly, without expressing any opinion on the merits of the matter, the Station House Officer, Kadiri Town Police Station, Anantapur District, is directed to follow the procedure laid down under Section 41-A of Cr.P.C. before arrest of the petitioners/ A.1 & A.2.

With the above direction, this Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
