HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.4970 of 2017 ORDER:

The prayer in the writ petition is reads as under: " to issue an appropriate Writ, order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondent No.2 herein in not entertaining the oral complaint of the petitioner dated 15-09-2016 against the respondents 3 to 5 as illegal, arbitrary, unconstitutional and violation of the Article 21 of the Constitution of India and consequently direct the respondent No.2 to register the crime against the respondents 3 to 5 and their associates and pass..."

Heard the learned counsel for petitioner, and the learned Government Pleader for Home (TG) for the respondents 1 & 2 and perused the prayer in the writ petition with supporting affidavit and the entire material on record. 3.

It is the supporting affidavit averment vis-à-vis the oral submission of the learned counsel for petitioner that there is inaction on the part of the police in not investigating the case even F.I.R. in Crime No.264 of 2016 dated 15.09.2016 is belatedly registered. On 24.04.2018, this Court directed to produce the G.D. entry and the same was produced on 27.04.2018 and on further verification returned the same. 4.

It is the submission of learned Government Pleader for Home (TG) vis-à-vis the Station House Officer, Musheerabad Police Station, Hyderabad, who is present, that the crime is registered and the investigation is in progress.

The

Dr. SSRB, J W.P. No.4970 of 2017 complainant says he has no further grievance, but for fair investigation.

Having regard to the above, this Writ Petition is disposed of directing the police to complete the investigation and file final report and intimate the same to the complainant within two (2) months from today. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
