THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.27880 OF 2012 ORDER:

Heard the learned counsel for the petitioner and the learned Public Prosecutor appearing for the respondents 1 to 4. The prayer sought in the writ petition is as under: "...............Writ of Mandamus directing the 3rd Respondent herein to further investigate in the Crime No.79 of 2009, dt.26.02.2009, to file Additional Charge Sheet in S.C.No.313 of 2011, on the file of Chief Metropolitan Sessions Judge, at Hyderabad, in the interest of justice and pass such other order......." On 13.03.2014, this Court passed orders to the effect that it is open for the 4th respondent to carry further investigation and make available the supplementary report under Section 173(8) of the Code of Criminal Procedure before the learned Sessions Judge and also make available the same in the Court within a period of 30 days in view of the principle enunciated by the Supreme Court in Bhagwat Singh v. Commissioner of Police1.

Learned Government Pleader appearing for the respondents 1 to 4 submit that pursuant to the said observations made by this Court, the respondent-police have investigated and filed Additional Charge Sheet on 14.09.2016 before the VI Additional Chief Metropolitan Magistrate, Hyderabad.

In that view of the matter, this Court is of the opinion that the grievance of the petitioner in the present writ petition is 1 1985 (2) SCC 537

satisfied, since an Additional Charge Sheet is filed after further investigation. As such, no further cause would survive in the writ petition.

Accordingly, the writ petition is closed. No order as to costs.

Pending miscellaneous petitions, if any, shall also stand closed.
