THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 16534 OF 2016 O R D E R :

The main grievance of the petitioners is that without following the due process of law, the authorities of the 4th respondent temple are requiring them to vacate their respective tenements and hand over the vacant possession thereof, for the purpose of road widening. When the matter came up for consideration on 19.05.2016, this Court, by way of interim order, directed that if the petitioners are the owners of the subject properties and they are in possession, they shall not be dispossessed without following the due process of law, in pursuance of the Government Memo No. 33/Endts.II/2016, dated 30.03.2016, for a period of four weeks.

Today, learned Standing Counsel for the 4th respondent temple Ms. K. Lalitha would submit that if the properties of the petitioners are required for a public purpose, they would be acquired after following the procedure as contemplated under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and till then, the possession of the petitioners over their properties will not be interfered with in any manner.

In view of the submission made by the learned Standing Counsel, the Writ Petition stands closed. No costs. Consequently, the miscellaneous Applications, if any shall also stand closed.
