THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.26584 of 2009 ORDER:

The grievance of the petitioner was as to the proceedings dated 03.12.2009 of the Additional Licencing Authority, Krishna District, disqualifying his driving licence for a period of six months with effect from 03.12.2009 or till the investigation was completed, whichever was earlier.

The basis for the impugned proceedings was that the petitioner allegedly drove his vehicle in a rash and negligent manner resulting in the death of a person. This incident was taken on file by the police authorities in Crime No.222 of 2009 on the file of Mungala Police Station.

By order dated 05.12.2009, this Court granted interim suspension of the impugned proceedings dated 03.12.2009. Upon instructions, the learned Assistant Government Pleader for Transport informed this Court that the investigation has also been completed and the driving licence seized from the petitioner was returned to him.

In that view of the matter, as the impugned proceedings were to have effect only for a period of six months or till the completion of the investigation, whichever was earlier, they can no longer be acted upon at this late stage. The impugned proceedings dated 03.12.2009 are accordingly set aside.

The writ petition is allowed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
