THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.16712 of 2016 ORDER:
The petitioner is a convict No.7084, who belongs to Nalgonda District. He sought for issuing a writ or order particularly in the nature of Mandamus declaring the action of respondents 1 and 2, who are the Principal Secretary, Home Legal (Prison) Department, and the Superintendent of Jail, Central Prison, Warangal; in not considering his application dt.17.05.2016 addressed to the Hon'ble Home Minister by marking the copy to the Principal Secretary, Home (Legal) Department, for extension of the parole for a period of four months as illegal and arbitrary and unconstitutional.
2. The reason stated for extension of parole is that the his mother is suffering from kidney ailment and the parole period is completing by 30.05.2016.
3. It is the submission of the learned Government Pleader for Home representing respondents 1 and 2 that under the discretion of the Government the application of the petitioner is in process.
4. Having regard to the above, the Writ Petition is disposed of directing the respondents to dispose of the representation of the petitioner before 30.05.2016 for any entitlement of any period of extension of parole or otherwise on merits. There shall be no order as to costs.
5. Consequently, miscellaneous petitions pending if any shall stand closed.
