THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 9225 of 2019 O R D E R:

This Writ Petition is filed seeking to declare the action of respondent No.2-Deputy Commissioner of Prohibition and Excise, Karimnagar in not releasing the stocks i.e., 6000 kgs of white jaggery seized in Crime No.471 of 2018, in spite of the readiness of the petitioner to furnish the third party security, as illegal and arbitrary and consequently, direct respondent No.2 to release the stocks.

Heard learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise appearing for the respondents.

Considering the facts and circumstances of the case, the writ petition is disposed of directing respondent No.2 to release the seized stocks to the petitioner, subject to his furnishing an F.D.R. in favour of respondent No.2 at the rate of Rs.30/- per kg of the white jaggery and the same shall be subject to the final orders that may be passed in the departmental proceedings. However, the other proceedings may go on.

Miscellaneous petitions, if any, pending in this writ petition shall also stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:26.04.2019 kdl
