THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE P.KESHAVA RAO WRI T PETI TI ON NO.9293 OF 2019 ORDER: (per SK,J) The grievance of the petitioner Partnership Firm is that despite repaying its loan fully, the State Bank of India, Miryalaguda Branch, Miryalaguda, is not returning its original title deeds which were deposited by way of an equitable mortgage to secure the said loan. The petitioner firm's representation dated 18.03.2019 made to the bank evoked no response constraining it to approach this Court. Notice before admission was ordered in this matter on 29.04.2019 and the respondent bank entered appearance through Sri P.V.Satyanarayana, learned counsel. However, there was no representation either for the respondent bank or its learned counsel when this matter was taken up for hearing on 27.06.2019 and thereafter, on 01.07.2019. It was accordingly directed to be listed under the caption 'for orders' on 03.07.2019.
Today, the matter is listed under the said caption but yet again, there is no representation for the respondent bank when the matter is taken up.
As it is the claim of the petitioner firm that it has cleared the loan account bearing No.62204913269 with the respondent bank and the subject title deeds were deposited to secure the said loan account, the writ petition is disposed of directing the respondent bank to consider the petitioner firm's representation dated 18.03.2019 in accordance with law and take appropriate action thereon. This exercise shall be completed
expeditiously and in any event, not later than two weeks from the date of receipt of a copy of this order, be it from whatever source.
