HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.18070 OF 2003 ORDER:

1. When this matter is taken up for hearing, it is noticed that that this writ petition was dismissed for default against respondent No.2. The impugned order in I.D.No.17 of 1997, dated 6.7.2000 was passed by the 1st respondent-Tribunal in favour of the contesting respondents. No steps were taken to get the writ petition restored against the contesting respondent. In the absence of the contesting respondent, this Court cannot adjudicate the case on merits.

2. Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
