Perused the contentions in the petition. Even the fact that the wife is living in adultery itself not a ground to say that the very maintenance case under Section 125 Cr.P.C. is not maintainable, but for if at all any such proof to contest of not entitled to maintenance or more than for bare survival.

Having regard to the above, the criminal petition is disposed of rather than dismissal, by left open all defences to impugn any entitlement.
