HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SRI JUSTICE Dr. SHAMEEM AKTHER WRIT PETITION NO.8073 OF 2017 ORDER: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) Sri K.S. Murthy, Learned Counsel for the petitioners would contend that the petitioners neither borrower nor guarantor of the loan; their land has been put to sale; and though they had submitted a representation to the authorized officer, on 12.03.2017 the said representation was neither considered nor any orders passed thereupon.
Both Sri M. Srikanth Reddy, Learned Standing Counsel for the 2nd respondent bank and Sri R. Rajendra Prasad, Learned Standing Counsel for respondents 3 and 4 would submit the subject property stands in the name of the 5th respondent; while the auction of the subject property was held on 08.03.2017, there are no bidders in the auction; and the cause in the Writ Petition does not survive. Sri R.
Rajendra Prasad, Learned Standing Counsel for respondents 3 and 4 would submit that the petitioners representation was examined and the decision of the respondents 3 and 4 to be communicated to him. Sri K.S. Murthy, Learned Counsel for the petitioners would submit that it would suffice if the respondents 3 and 4 are directed to dispose of the petitioners representation within a specified time frame. Sri R. Rajendra Prasad, Learned Standing Counsel has himself agreed that the respondents 3 and 4 would consider the petitioners representation, we consider it appropriate to dispose of the Writ Petition directing them to do so and communicate
their decision to the petitioners at the earliest preferably within three weeks from today.
