THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CCCA MP No.351 of 2015 in CCCA No.222 of 2007 and CCCA No.222 of 2007 Common Order:
Appellant-Sri Govind Rao Deshpande and his counsel Sri J.Srinivasa Rao are present. R5-Smt.Vidhya Paropkari absent and she is represented by GPA-cum-husband Sri Vijay Paropkari s/o Balwant Rao Paropkari and her counsel are present. R1 to R4 are absent.
2) Learned counsel on both sides submitted that appellant filed O.S.No.463 of 1999 on the file of II Additional Chief Judge, City Civil Court, Hyderabad for partition of suit schedule property against respondents R1 to R5 who are the brothers and sister and the said suit was dismissed on 12.02.2007. Aggrieved, he filed CCCA No.222 of 2007. When the appeal is pending, at the intervention of elders the present appellant and R5 compromised the issue and as per the terms of compromise, the appellant admits and acknowledges the validity of Ex.B2-gift deed dated 09.07.1992 and as per which R5 has paid Rs.5,50,000/- (Rupees five lakhs fifty thousand only) which he has received and he has no objection for dismissal of appeal against all the respondents. To that effect the parties filed compromise memo and they admitted the terms of compromise.
3) In view of the compromise entered into by the parties, CCCA No.222 of 2007 is dismissed without costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
