HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CIVIL REVISION PETITION No.1566 OF 2018 ORDER:
This revision under Article 227 of Constitution of India is filed challenging the order in I.A.No.5573 of 2017 in O.P.No.569 of 2016 dated 03-01-2018 passed by Chief Judge, City Civil Court, Hyderabad-cum-Election Tribunal modifying the order dated 05-12-2017 and main contention before this Court is that order is not reasoned and unsustainable order. No doubt, the order is bereft of any reasons but Sri J.Prabhakar Rao, counsel for the respondent No.1 undertakes that he will examine the concerned official of G.H.M.C. who issued certificate and requested this Court to direct the Chief Judge to proceed with the matter treating marking of documents for numerical purpose on tentatively and request to pass appropriate order.
No doubt, the impugned order is not reasoned. But in view of undertaking given by the counsel for respondent No.1 supra marking is only tentative marking for numerical purpose, subject to proof of documents by examining the concerned official of G.H.M.C. and in the event of failure to examine the concerned official, the Court below take steps to summon the concerned official and on filing said application, the Court shall pass appropriate order as per law to avoid unnecessary multiplication of proceedings either before this Court or before Chief Judge, City Civil Court, Hyderabad-cum-Election Tribunal in G.H.M.C.
With the above direction, the revision is disposed of. In consequence, Miscellaneous Petitions, if any, pending in this revision petition shall stand dismissed.
