HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 46049 of 2016 Order:

This Writ Petition was filed challenging the registration of Crime No.222 of 2016 on 16.11.2016 on the basis of complaint given by the fourth respondent.

After registration of the crime, when the police were not investigating, the fourth respondent appears to have filed W.P.No.44360 of 2016 and this Court, by order dated 20.12.2016, disposed of the same by directing the respondents 2 to 4 therein to conduct investigation of the crime, complete the same and file a final report as expeditiously as possible.

This Writ Petition was filed after disposal of the said Writ Petition as aforesaid. There cannot be any contrary order in the present Writ Petition.

In the circumstances, this Writ Petition is also disposed of giving liberty to the respondents 2 and 3 herein to conduct investigation in respect of Crime No.222 of 2016 dated 16.11.2016, complete the same and file a final report as expeditiously as possible. Since this Court noticed that the complaint was a counter blast to the earlier complaint made by the petitioner on 11.11.2016 and also entertains a doubt with regard to genuinity of the complaint, the petitioner shall not be arrested except without obtaining appropriate orders from the concerned Magistrate.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
