THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.10372 of 2016 ORDER:

This criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.15 of 2014 on the file of Special Judge for SPE & ACB Cases, Karimnagar, registered against the petitioner/A.1 for the offence punishable under Sections 7 and 13(1)(d) r/w 13(2) of Prevention of Corruption Act, 1988 read with 34 IPC. Heard the learned counsel appearing for the petitioner/A.1 and the learned Additional Public Prosecutor, representing the State. From a perusal of the complaint it cannot be said that there is no material to proceed against the petitioner. Therefore, it is not a fit case where the proceedings against him can be quashed. In the facts and circumstances of the case, this criminal petition is disposed of giving liberty to the petitioner/A.1 to avail the remedy available to him under Section 227 Cr.P.C. seeking discharge. As and when such petition is filed, the Court below shall decide the case on merits expeditiously.

Pending miscellaneous applications, if any, shall stand closed in consequence.
