HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.3039 OF 2003 ORDER :

This Writ Petition is filed seeking a writ of mandamus declaring the order of the 1st respondent in I.D.No.72 of 2002, dated 02.09.2002 as illegal, arbitrary and consequently set aside the same.

Heard Mr.G.Madhusudan Reddy, learned Counsel for petitioner and learned Government Pleader for Industries appearing for respondents. 3.

It has been contended by the petitioner that the 2nd respondent workman was engaged in Hyderabad Race Club on race days only and he was not engaged on permanent basis. It has been further contended by the petitioner that the 2nd respondent entered into book making ring by purchasing the ticket and he was caught red handed by the security staff while carrying on illegal betting activity. Hence, he was orally terminated from service. Aggrieved by the same, the 2nd respondent filed I.D.No.72 of 2002 before the Industrial Tribunal-II. The Industrial Tribunal-II had passed orders on 2.9.2002 directing reinstatement of the 2nd respondent workman into service with back wages. Challenging the same, he filed the present Writ Petition is filed.

It has been contended by the learned Counsel for the petitioner that the Industrial Tribunal-II has erroneously passed the orders in favour of the workman and the same is liable to be set aside.

Learned Counsel for the 2nd respondent workman had submitted that the Industrial Tribunal has rightly passed the orders, and no interference is called for from this Court.

Considering the rival submissions made by both the parties, this court is of the view that there is no irregularity or illegality in the orders passed by the Industrial Tribunal Court and the Writ Petition is liable to be dismissed. Accordingly, Writ Petition is dismissed. No costs. 7.
