THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.25619 of 2003 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) The applicant in O.A.No.3636 of 1998 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad, is before this Court aggrieved by the dismissal of the said O.A. by order dated 23.09.2003. The claim of the petitioner/applicant before the Tribunal was that he should have been considered for promotion in the panel year 1995-96 pursuant to the recommendation of the Departmental Promotion Committee. The petitioner/applicant was actually promoted on 13.10.1997 and in effect, his claim was for a retrospective promotion. By the order under challenge, the Tribunal denied him the said relief.

It is fairly stated by Sri N. Gurugopal, learned counsel for the petitioner, that the petitioner/applicant retired as long back as in the year 2006.

That being so, we are of the opinion that the claim of the petitioner/applicant for retrospective promotion cannot be considered at this late stage. In any event, the petitioner/applicant has no indefeasible right to claim such promotion at a particular point of time as per his choice.

The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
