HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.2 and 3 of 2019 In/and CRIMINAL PETITION No.2517 of 2019 ORDER:
1) The petitioners, who are accused Nos.1 to 3, filed this Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of the proceedings in C.C.No.336 of 2015 on the file of the IV Metropolitan Magistrate, Cyberabad at Ibrahimpatnam, Ranga Reddy District. 2) A charge sheet came to be filed against the petitioners/ accused Nos.1 to 3 for the offences punishable under Sections 324, 147, 148 and 149 IPC, which was numbered as C.C.No.336 of 2015 on the file of the IV Metropolitan Magistrate, Cyberabad at Ibrahimpatnam, Ranga Reddy District.
3) During pendency of the Criminal Petition, I.A.Nos.2 and 3 of 2019 came to be filed to permit and record the compromise. The Joint Memo filed along with the compromise petition would disclose that both the parties have settled their disputes amicably before the District Legal Service Authority, Ranga Reddy at L.B.Nagar in PLC No.247 of 2018 and they are living in peace and harmony.
4) Today, the parties are present before this Court and they also filed their proof of identification. When examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and the respondents 2 to 4
have no objection for quashing the proceedings against the petitioners. The affidavit of the de facto complainants also indicates the same.
5) Taking into consideration the settlement arrived at between the parties and since respondents 2 to 4 are not interested to prosecute the case against the petitioners, continuation of proceedings against the petitioners in the above case would amounts to an abuse of process of law.
6) Accordingly, I.A.Nos.2 and of are ordered.
Consequently, the Criminal Petition is allowed and the proceedings against the petitioners in C.C.No.336 of 2015 on the file of the IV Metropolitan Magistrate, Cyberabad at Ibrahimpatnam, Ranga Reddy District, are hereby quashed. Miscellaneous petitions, if any, pending, shall stand closed.
