HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1755 OF 2015 O R D E R:
The Writ petition is filed questioning the proceedings No.76118/2014, dated 06.12.2014, initiated by the 3rd respondent-Tahsildar, Chintalapudi Mandal on the complaint made by the 5th respondent.
The grievance of the petitioner is that even without furnishing a copy of the complaint and the allegations said to have been made by one Sri Gummalla John Sudarsana Rao, S/o Devadasu of Chintalapudi Village and Mandal, against her, the Tahsildar-3rd respondent is proceeding with the enquiry vide proceedings No.76118/2014, dated 06.12.2014. As a matter of fact, she has made a request for furnishing a copy of the Complaint No.108, dated 22.09.2014 and other related papers. It is submitted by the petitioner that though initially the 3rd respondent listed the enquiry for hearing on 21.01.2015, the same was adjourned and as of now, no new date has been fixed for hearing.
Learned counsel for the petitioner submits that the petitioner would be satisfied as of now if a direction is issued to the respondents, particularly to the 3rd respondent, to furnish copy of the complaint which said to have been made against the petitioner and by giving opportunity to the petitioner to submit her explanation without prejudice to her rights.
Learned Assistant Government Pleader does not have any
objection for passing order.
In those circumstances, the 3rd respondent is directed to furnish copy of the complaint, said to have been made against the petitioner by the 5th respondent, and any other communication the 3rd respondent might have received from other revenue officials against the petitioner and give her adequate opportunity to present her case. It is also made clear that the 3rd respondent shall also provide opportunity of hearing the petitioner or petitioner's counsel, in case she desires the same.
With the above direction, writ petition is disposed of at the admission stage. There shall be no order as to costs. Consequently, the miscellaneous petitions filed in this writ petition shall also stand disposed of.
