Sk.Tajuddin,Kothagudem,Khammam v. The Labour Court, Its Presiding Officer Warangal
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 25849 of 2002 O R D E R:- Heard Sri G. Ravi Mohan, learned counsel for the petitioner and Sri K. Harinath, learned Standing Counsel for Andhra Pradesh State Road Transport Corporation appearing on behalf of the 2nd respondent and perused the material placed on record. It is noticed from the record that the petitioner has attained the age of superannuation and at this point of time, there cannot be any direction to reinstate him into service. The petitioner has challenged the order dated 14.08.2002 in I.D.No. 113 of 2000 passed by the Industrial Tribunal-cum-Labour Court, Warangal, whereby no relief has been granted to him. The learned counsel for the petitioner contends that at least, service benefits of the petitioner for the services rendered by him from the date of his initial appointment till the date of removal from service be directed to be paid.
The learned Standing Counsel has not disputed the entitlement of the petitioner for service benefits for the services rendered by him prior to the orders of removal. In view of the above, this writ petition can be disposed of directing the 2nd respondent to pay service benefits to the petitioner for the services rendered by him prior to his removal, within a period of four weeks from the date of receipt of a copy of this order.
AKS,J WP_25849_2002 With the above observation, the writ petition is disposed of. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
