HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.24209 of 2017 ORDER:
Heard Mr. Shafath Ahmed Khan for petitioner and the learned Assistant Government Pleader (Revenue) for respondents 1 to 4.
2. The petitioner complains against inaction of 3rd respondent in considering and disposing of the stay application and the appeal filed by the petitioner against the order dated 22.02.2017 of 4th respondent, as illegal and amounts to refusing to exercise jurisdiction conferred on 3rd respondent.
3. At request of the Assistant Government Pleader, the writ petition is directed to be listed today to enable him to get instructions on the stage of stay application and the appeal filed by the petitioner. On instructions, he submits that the interim application filed by petitioner is heard and the matter reserved for orders. As regards appeal is concerned, the 3rd respondent is prepared to dispose of the appeal expeditiously. The statement is placed on record.
4. The writ petition is disposed of by this order. a) The 3rd respondent is directed to consider and dispose of the stay application filed by petitioner within three weeks from today and further directed to dispose of the appeal expeditiously, preferably within three months from the date of receipt of a copy of this order; b) The 4th respondent ensures maintenance of status quo of subject matter of writ petition as regards possession and
physical features for a period of three weeks from today.
