THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 11156 OF 2017 O R D E R:

The grievance of the petitioner in this writ petition is that with respect to the land acquired, the respondent authorities are likely to pay the entire compensation to respondent No.5 by ignoring his claim.

Learned counsel for the petitioner asserts that the petitioner is the legal heir of late Mallaiah and he is also entitled to receive compensation for the land acquired for the purpose of Seetharama Project pursuant to the notification issued under Section 4(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Settlement Act, 2013 (for short 'the Act'), on 23.01.2017.

Sri M.Rajamalla Reddy, learned counsel for respondent No.5, submits that declaration under Section 19 of the Act was issued on 07.04.2017, however, no Award has been passed as on date. He fairly submits that respondent No.5 has no objection to consider the claim of the petitioner in the process of award enquiry.

In those circumstances, the writ petition is disposed of with the direction to respondent No.3 to consider the claim of the

petitioner as well as respondent No.5 while determining the compensation in the process of award enquiry. The petitioner as well as respondent No.5 shall be entitled to place necessary material in support of their respective claims. Consequently, miscellaneous applications, if any shall stand disposed of. No costs.
