SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL MISCELLANEOUS APPEAL No.376 OF 2014 JUDGMENT: (Per Hon'ble Sri Justice R. Subhash Reddy) This appeal is filed by the defendants in O.S.No.111 of 2013 pending on the file of learned I Additional District Judge, Medak at Sangareddy, aggrieved by the order and decree, dated 24.01.

2014, passed in I.A.No.538 of 2013 in the said Suit. Respondent-plaintiff filed the aforesaid Suit for specific performance of agreement of sale, dated 03.10.2011. Pending Suit, he obtained ex parte injunction orders restraining the appellants from alienating the suit schedule lands and creating charge over the same pending disposal of the main Suit. On filing counter and on hearing both sides, by impugned order, dated 24.01.2014, the earlier ad interim injunction order passed on 20.07.2013 was made absolute. When the matter is called, it is submitted by the learned counsel for appellants that the Suit itself is now listed for trial and the trial is likely to be commenced. From a perusal of the order passed by the trial Court, it is clear that there is continuous injunction in favour of the respondent from 20.07.2013 onwards.

It is also clear that pursuant to the agreement of sale, part consideration was paid to the appellants-land owners. Though time is essence of contract, the same is the matter to be considered by the trial Court while disposing of the Suit, but the same is not a ground to interfere with the impugned order at this stage. However, we deem it appropriate to dispose of the appeal with a direction to the learned I Additional District Judge, Medak, to dispose of the Suit as expeditiously as possible, preferably within a period of six (6) months from today. Subject to the above, the appeal is disposed of. Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
