HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.287 OF 2017 ORDER:

The Revision is filed against the order dated 19.12.2016 passed in Crl.M.P. No.250 of 2016 in Crl.A. No.979 of 2016 on the file of III Additional District and Sessions Judge, Ranga Reddy District at L.B Nagar (for short 'the Appellate Court').

2) It is the contention of the learned counsel for the petitioner that the lower appellate Court ordering 1/ 3rd amount of arrears of maintenance amount in granting stay on its face is unjust and that too, without ordering future payment of maintenance at that rate but for confirming arrears while granting stay that is liable to be set-aside.

3) Heard both sides and perused the material on record. 4) As the impugned order speaks only payment of 1/ 3rd of the arrears of amount of maintenance within two (2) weeks and not anything with regard to future maintenance while granting interim stay, the revision is disposed of by extending the same including for future maintenance at the same rate and with a direction to the lower Court to dispose of the appeal within a period of two months from the date of receipt of a copy of this order. However, it is made clear that the interim order of 1/ 3rd of arrears of amount of maintenance along with future maintenance, to be paid, no way

influence the mind of the lower appellate Court in determining the appeal lis before it on its own merits.

5) Accordingly and in the result, this Criminal Revision Case is disposed of. As a sequel, miscellaneous petitions if any pending shall stand closed.
