THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.20686 OF 2004 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the proceedings No.SE/O/VJA/Adm.U2/D.No.252 dated 27.01.2004 on the file of the second respondent as ex-facie illegal, arbitrary, without jurisdiction and contrary to the orders of this Court and to set aside the same and consequently direct the respondents to forthwith appoint the petitioner as Junior Lineman in the existing vacancies by considering the petitioner's eligibility criteria as per BPMS. No.36, dated 18.05.1997. Heard the learned counsel for both parties.

The second respondent passed the impugned order on 27.01.2004. For better appreciation, it is not out of place to extract the relevant portion of the impugned order, which is as follows: "Your case will be considered as per the orders of Hon'ble High Court as and when the filling up of vacancies from among the casual labour, contract labour and V.E.Ws take place."

At the time of arguments, learned counsel for the respondents submitted that the respondents will consider the case of the petitioner in future vacancies.

In view of the submission made the learned counsel for the respondents, the Writ Petition is disposed of with a direction to the respondents to consider the candidature of the petitioner in future vacancies. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
