HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.10525 of 2008 ORDER:
The action of the respondents in blacklisting the petitioner, without putting him on notice and without giving him an opportunity of being heard, is questioned in this Writ Petition as being arbitrary and illegal.
An interim order was passed on 07.05.2008 which was made absolute on 22.10.2010. The fact that the petitioner was not put on notice before he was black-listed is not in dispute. I consider it appropriate, therefore, to set aside the impugned order, leaving it open to the respondents to put the petitioner on notice with regards black-listing, give him an opportunity of being heard, and to thereafter pass orders in accordance with law. The Writ Petition is, accordingly, disposed of.
The Miscellaneous Petitions pending, if any, shall also stand dismissed. No order as to costs.
