SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.2 7 2 8 of 2 0 1 1 ORDER:

When the matter was taken up for hearing on 07.11.2017, as none appeared, it was directed to be listed under the caption 'For Dismissal'. Even today, when the matter is taken up for hearing, neither the petitioners appear nor there is any representation on their behalf. Hence, the petition is taken up for disposal on merits. 2.

This petition is filed for quash of the proceedings in FIR.No.33 of 2011 dated 17.03.2011 on the file of the Vissannapeta Police Station, Krishna District.

3.

Heard the learned Public Prosecutor for the first respondent. 4.

The offences alleged against the petitioners are under Sections 307, 498 read with Section 34 of the Indian Penal Code. A perusal of the complaint would show that the allegations pertaining to Section 498A IPC are very categorical and there is an allegation that the first petitioner attempted to commit murder of the complainant. Hence, in view of the aforesaid allegations, which, prima Facie, constitute the alleged offences, this Court opines that it is not a fit case for quash of the proceedings against the petitioner.

The criminal petition is dismissed. The interim stay, granted earlier in CRLPMP.No.2866 of 2011 dated 25.03.2011 shall stand vacated. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
