HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7664 OF 2018 ORDER:

This writ petition is filed challenging the action of the third respondent in refusing to register the document presented by the petitioner in respect of semi finished flat No.402 (in fourth floor) with built up area of 1075 square feet (including common area) along with an undivided share of land admeasuring 43.00 sq.yds (out of 388.00 sq.yds) on plot No.21 in Sy.No.145 in M.C.K. Block No.2 of Adarsha Enclave situated at Sardarpatel Nagar, Hydernagar Village, Kukatpally Municipality, Balanagar Mandal, Ranga Reddy District, without assigning any reasons.

It is needless to observe that when a properly drafted document is presented for registration complying with all formalities, the respondents 2 and 3 have no alternative except to receive the said document and they cannot refuse to receive the document.

In the circumstances, the writ petition is disposed of directing the respondents 2 and 3 to receive the document, if any, presented by the petitioner and take action in accordance with the provisions of the Registration Act. If the respondents 2 and 3 cannot register the said document for any reason, they have to make an endorsement to that effect and pass an order in accordance with Section 71 of the Registration Act The writ petition is accordingly disposed of.
