THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE D.V.S.S.SOMAYAJULU WRI T PETI TI ON No.7626 OF 2018 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) Challenge in this writ petition is to the e-auction notice dated 03.02.2018 issued by the Canara Bank, ARM Branch, Hyderabad, the respondent herein, proposing to conduct e-auction of the secured asset belonging to the petitioner on 12.03.2018.

However, Sri P.N.Swamiji, learned counsel for the respondent bank, would inform this Court that the impugned e-auction notice dated 03.02.2018 has been cancelled and therefore the question of holding the auction on 12.03.2018 does not arise.

As the challenge in this writ petition is only directed against the said e-auction notice and we are informed that it has worked itself out due to its cancellation by the bank, the writ petition no longer survives for consideration on merits.

The writ petition is accordingly dismissed leaving all issues open. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
