HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No. 9339 of 2019 ORDER:

1) The present Writ Petition came to be filed seeking issuance of Writ of Mandamus declaring the action of the first respondent in not appointing the petitioner as Sadar Kazi under the provisions of Kazis Act, 1880 to render Qazzat Services of Durki Qazzat even though the third and fourth respondent have submitted reports in favour of the petitioner, as illegal and arbitrary.

2) Heard learned counsel for the petitioner and Mr.M.A. Mujeeb, learned Standing Counsel for Wakf Board.

3) It is the case of the petitioner that despite the recommendations made by third and fourth respondent, no steps have been taken by the first respondent though he is having conferred with the powers to appoint the petitioner as a Khazi.

4) Without going into the merits of the case, the Writ Petition is disposed of, directing the first respondent to consider and pass appropriate orders in filling up the vacancy of 'Sadar Kazi' in the light of the recommendations made by third and fourth respondent in its true law and spirit, as

expeditiously as possible, preferably, within a period of four

(04) weeks from the date of receipt of a copy of the order.

5) Consequently, miscellaneous petitions if any pending in this writ petition shall stand closed. No order as to costs. __________________ T. AMARNATH GOUD, J 29.04.2019 gkv
