THE HON'BLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No.11018 of 2016 ORDER:
Heard learned counsel appearing for the petitioner and the learned Additional Public Prosecutor for the 1st respondent - State and the learned counsel for the 2nd respondent - de facto complainant.
This criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in Crime No.835 of 2016 on the file of L.B.Nagar Law and Order Police Station, Cyberabad at L.B.Nagar, Ranga Reddy District, registered against the petitioner, who is sole accused, for the alleged offence punishable under Section 337 IPC.
Today, when the matter came up for hearing, the learned counsel for the petitioner submitted that the parties have amicably settled the matter and filed Crl.M.P.Nos.12098 and 12099 of 2016 in Crl.P.No.11018 of 2016 to permit them to compound the above offence, as the said offence is compoundable, and to quash the proceedings.
Both the parties are present and submitted that they have amicably settled the matter and the respondent No.2/ de facto complainant may be permitted to compound the above offence. The parties are identified by their counsel. Both the parties have signed in the joint memorandum of compromise and the same has been counter signed by their respective counsel. In view of these
circumstances the Crl.M.P.Nos.12098 and 12099 of 2016 in Crl.P.No.11018 of 2016 are allowed and the joint memorandum of compromise is made part of this order.
The proceedings in Crime No.835 of 2016 on the file of L.B.Nagar Law and Order Police Station, Cyberabad at L.B.Nagar, Ranga Reddy District, registered against the petitioner, who is sole accused, for the alleged offence punishable under Section 337 IPC are hereby quashed and the criminal petition is allowed in terms of the compromise.
